Does a signed waiver save me from law suits?
I am thinking of hiring am adult student (or a handyman) to trim my cedar hedge in my garden. I will provide the tools – electric trimmer and a ladder – to do the job. Now, I want to know, whether he could sue me if he hurts himself either from falling down the ladder or cuts himself? And, if so, will asking him to sign a waiver not to sue for injuries before the job save me from any law suit or compensation?
PS. Sorry this question may not be for this forum, but I think there may be more people knowing the laws here.
He can indeed sue you. The ONLY way you are safe is to require him to carry worker’s compensation insurance. If you are the employer, you are required to carry insurance, which PROBABLY is covered by your homeowner’s insurance. Call them and ask.
The general principle is that one may not sign away one’s right to sue for negligence (meaning a waiver means nothing)
